The entitlement of copyright benefits for an artist has been termed along their lifespan plus 50 years after death, according to the “Burma (Myanmar) Copyright Laws” enacted in 1914 during the colonial period.

Such copyright law was recognized in many countries since Bam Convention in 1886, and the UK ratified the copyright law in 1911. Therefore, its colonial countries also adopted this law.


“Myanmar has adopted the copyright law in 1914 under the colonial rule. This law is comprised of two categories. The first one dealt with the labels of industrial products, industrial designs and regional references. They are not related with artistic works. The second one is about the copyright benefits of artist.


The rights of artist are connected with literature, music, movie, drama and ten traditional arts and crafts. An artist has the intellectual property ownership rights from its imaginative creation. The copyright law about the arts has revealed that the benefit for a creator is entitled the whole lifetime of creator plus 50 years after death. Only a few people knew about this law and practiced it,” said U Aung Soe Oo at the workshop for copyright law. Moreover the copyright law stipulates direct benefits for some artistes, while some other rights are regarded as they can get indirect benefits.


“It was learnt that EU countries and India have extended the years for benefits after death of the creator. Myanmar has not prolonged the term in this regards. The new constitution of the country has incorporated the copyright law,” U Aung Soe Oo concluded.
